ORDERS:

Orders are subject to Concours Specialties acceptance. Concours Specialties reserves the right to limit quantities and to refuse to deal with any person.

PRICES:

All prices are in US dollars and subject to change without notice.

SHIPPING:

Orders placed before 3PM Monday – Friday EST (excluding holidays), usually are shipped the same day. This applies to in stock products and excludes special order and custom built items.

RETURNS:

New items may be returned up to 30 days from original purchase date. No returned items accepted for credit or exchange without written authorization. Freight must be prepaid and copy of the original invoice included. Only 100% new, undamaged and complete items will be accepted for returns. All containers, packing, instructions and accessories must be included in returns. Defective items will be exchanged, credited or refunded at our sole discretion. Items qualifying for free shipping will have the original shipping charges deducted from any refund amount. All returns subject to 15% handling charge.

 

SPECIAL ORDERS AND CUSTOM PRODUCTS:

No returns or refunds on special orders or custom products.

 

CLAIMS:

All claims for incorrect or incomplete shipments must be made within 24 hours of receipt of shipment for adjustment consideration. Claims for damage must be made directly with carrier. Do not return damaged goods.

WARRANTY:

All products carry a one-year warranty for repair or replacement. All products are warranted to be free of defects in material and workmanship at time of delivery. Concours Specialties will in no way be liable for more than cost of original product and in no event will Concours Specialties be liable for special, indirect or consequential damages of any kind whatsoever.

SAVE AS EXPRESSLY PROVIDED IN THESE TERMS AND CONDITIONS, ALL IMPLIED WARRANTIES, TERMS AND CONDITIONS (WHETHER STATUTORY OR OTHERWISE) ARE EXCLUDED TO THE FULLEST EXTENT PERMITTED BY LAW. IN PARTICULAR, CONCOURS SPECIALTIES MAKES NO WARRANTY RESPECTING THE MERCHANTABILITY OF THE PRODUCTS OR THEIR SUITABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE OR USE OR RESPECTING INFRINGEMENT.

Users/Customers of products agree not to hold Concours Specialties responsible for any damages occurred by improper installation or use of any products.

LIMITATION OF LIABILITIES:

CUSTOMER SHALL NOT BE ENTITLED TO, AND CONCOURS SPECIALTIES SHALL NOT BE LIABLE FOR, LOSS OF PROFIT, PROMOTIONAL OR MANUFACTURING EXPENSES, OVERHEADS, BUSINESS INTERRUPTION COSTS, REMOVAL OR REINSTALLATION COSTS, INJURY TO REPUTATION OR LOSS OF CUSTOMERS, PUNITIVE DAMAGES, IPR INFRINGEMENT, LOSS OF CONTRACTS OR ORDERS OR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY NATURE. CUSTOMER’S RECOVERY FROM CONCOURS SPECIALTIES FOR ANY CLAIM SHALL NOT EXCEED THE PURCHASE PRICE PAID FOR THE AFFECTED PRODUCTS IRRESPECTIVE OF THE NATURE OF THE CLAIM WHETHER IN CONTRACT, TORT, WARRANTY, OR OTHERWISE.

FORCE MAJEURE:

Concours Specialties will not be liable for delays in delivery or for failure to perform its obligations due to causes beyond its reasonable control, including, but not limited to, product allocations, material shortages, labor disputes, transportation delays, unforeseen circumstances, acts of God, acts or omissions of other parties, acts or omissions of civil or military authorities, Government priorities, fire, strikes, floods, severe weather conditions, computer interruptions, terrorism, epidemics, quarantine restrictions, riots, or war. Concours Specialties time for delivery or performance will be extended by the period of such delay or Concours Specialties may, at its option, cancel any order or remaining part thereof without liability by giving notice to Customer.
